Terms of Service — Toploadr

These Terms of Service ("Terms") govern your use of the Toploadr mobile app and this website (together, the "Service"). The Service is operated by Nicky Jansen, an individual based in the Netherlands ("Toploadr", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

1. What Toploadr is

Toploadr is a tool for collectors to scan, catalogue, and track Pokémon and other trading cards, record what you paid and sold for, manage a wishlist, and link out to marketplaces. It is a personal organization and record-keeping tool — not a marketplace, broker, dealer, or financial service.

2. Eligibility & your account

You must be at least 16 years old to create an account and use the Service.
You're responsible for the information you provide and for keeping your login credentials secure. You're responsible for activity that happens under your account.
Provide accurate information when signing up, and let us know if your contact details change.

3. Your content

The data you add — cards, photos, prices, notes, wishlists, and trades — is yours. You grant us only the limited permission needed to host, process, and display that content back to you so the Service works. You're responsible for your content and for having the right to upload any photos you add. You can export or delete your data at any time (see section 8).

4. Acceptable use

When using the Service, you agree not to:

break the law, infringe others' rights, or upload unlawful or harmful content;
attempt to disrupt, reverse-engineer, scrape, overload, or gain unauthorized access to the Service or its infrastructure;
resell, sublicense, or commercially exploit the Service without our permission;
misuse the card-scanning feature to process content that isn't a trading card.

5. Prices, card data & no financial advice

Card identification (including AI-assisted scanning) and any price information are provided on a best-effort, "as is" basis and may be inaccurate, incomplete, or out of date. The amounts you see for what you "invested" or "earned" are calculated from figures you enter. Toploadr does not provide investment, financial, tax, or trading advice, and nothing in the Service is a recommendation to buy, sell, or hold anything. Decisions you make based on the Service are your own responsibility.

6. Marketplace links

The Service links out to third-party marketplaces such as CardMarket so you can view live prices and buy or sell. Those services are independent, have their own terms and privacy policies, and are outside our control. Toploadr is not affiliated with, and not responsible for, any transaction you make on a third-party marketplace.

7. Intellectual property

The Toploadr app, website, name, logo, and design are owned by us and protected by intellectual-property law. These Terms don't transfer any of those rights to you beyond the limited right to use the Service. Pokémon, the Pokémon TCG, Nintendo, and CardMarket — and all related names, marks, and card artwork — are the property of their respective owners. Toploadr is an independent tool and is not affiliated with, endorsed by, or sponsored by Nintendo, The Pokémon Company, or CardMarket.

8. Account deletion & termination

You can delete your account and associated data at any time from within the app (Dashboard → Account verwijderen). We may suspend or terminate access if you materially breach these Terms or use the Service unlawfully. You can stop using the Service at any time.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind to the maximum extent permitted by law. We don't guarantee that the Service will be uninterrupted, error-free, or that card data or prices will be accurate. This does not exclude any warranty that cannot be excluded under applicable law.

10. Limitation of liability

To the extent permitted by law, Toploadr is not liable for indirect or consequential losses, or for loss of data or profit, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law — in particular, your mandatory rights as a consumer under Dutch and EU law are not affected.

11. Changes

We may update the Service and these Terms as the app evolves. We'll change the "last updated" date above and, for material changes, give notice in the app or on this site. Continuing to use the Service after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the Netherlands, without affecting any mandatory consumer-protection rules of the country you live in. Disputes will be handled by the competent Dutch courts, unless mandatory law gives you the right to bring them elsewhere.
