Terms of Service

These Terms of Service ("Terms") govern your use of the Toploadr mobile app and this website (together, the "Service"). The Service is operated by Nicky Jansen, an individual based in the Netherlands ("Toploadr", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

01What Toploadr is

Toploadr is a tool for collectors to scan, catalogue, and track trading cards, record what you paid and sold for, manage a wishlist, and link out to marketplaces. It is a personal organization and record-keeping tool, not a marketplace, broker, dealer, or financial service.

02Eligibility & your account

• You must be at least 16 years old to create an account and use the Service.
• You're responsible for the information you provide and for keeping your login credentials secure. You're responsible for activity that happens under your account.
• Provide accurate information when signing up, and let us know if your contact details change.

03Your content

The data you add, cards, photos, prices, notes, wishlists, and trades, is yours. You grant us only the limited permission needed to host, process, and display that content back to you so the Service works. You're responsible for your content and for having the right to upload any photos you add. You can export or delete your data at any time (see section 9).

04Acceptable use

When using the Service, you agree not to:

• break the law, infringe others' rights, or upload unlawful or harmful content;
• attempt to disrupt, reverse-engineer, scrape, overload, or gain unauthorized access to the Service or its infrastructure;
• resell, sublicense, or commercially exploit the Service without our permission;
• misuse the card-scanning feature to process content that isn't a trading card.

05Prices, card data & no financial advice

Card identification (including AI-assisted scanning) and any price information are provided on a best-effort, "as is" basis and may be inaccurate, incomplete, or out of date. The amounts you see for what you "invested" or "earned" are calculated from figures you enter. Toploadr does not provide investment, financial, tax, or trading advice, and nothing in the Service is a recommendation to buy, sell, or hold anything. Decisions you make based on the Service are your own responsibility.

06Toploadr Pro, prices & renewal

Toploadr is free to use with monthly limits on scanning and price lookups, and a limit on how many cards your collection can hold. Toploadr Pro removes those limits. The free plan does not expire, and nothing you have already added is ever removed or hidden, a limit only stops you adding more.

Price and billing

Pro is an auto-renewing subscription, offered monthly and yearly. The exact price for your country, including VAT, is shown on the purchase screen in the app before you confirm, that price is what applies. Payment is charged to your Apple ID or Google Play account when you confirm the purchase. Apple and Google are the seller of record for the subscription; we never receive or store your payment details.

Renewal and cancellation

Your subscription renews automatically at the end of each period unless you cancel it before then: on Apple, at least 24 hours before the period ends, because Apple charges the renewal within the last 24 hours; on Google Play, any time before the renewal date. You can cancel at any time in your Apple ID account settings, or in the Google Play Store app under Payments & subscriptions → Subscriptions; cancelling stops future renewals and you keep Pro until the end of the period you already paid for. Deleting the app does not cancel a subscription.

Right of withdrawal (EU/EEA consumers)

As a consumer in the EU/EEA you normally have 14 days to withdraw from a distance contract. Because Pro is digital content that is made available immediately, you are asked to agree, at the moment of purchase, through the app store, that performance begins right away, and you thereby lose that right of withdrawal once the subscription is active. This does not affect your statutory rights if the service is faulty.

Refunds

Refunds are handled by the store you bought through, under that store's policy: reportaproblem.apple.com for Apple, or your order history in Google Play. We cannot issue refunds for purchases made through a store, but if something went wrong, email info@toploadr.app and we will help you sort it.

Cancelling a yearly subscription (Dutch consumers)

Under Dutch law (the Wet van Dam), once a subscription has renewed automatically for the first time, a consumer may cancel it at any time with a notice period of no more than one month. Apple's yearly subscriptions do not offer that mid-term cancellation through the store. If you are a consumer in the Netherlands and you want to end a renewed yearly subscription before its period is over, email info@toploadr.app and we will arrange it, including a refund of the unused part of the period. This right exists regardless of what the store's cancellation screen offers you.

Price changes

We may change the price of Pro. An increase never applies to a period you have already paid for, and you will be notified through the store before it takes effect, with the opportunity to cancel.

07Marketplace links

The Service links out to third-party marketplaces such as Cardmarket and eBay so you can view live prices and buy or sell. Those services are independent, have their own terms and privacy policies, and are outside our control. Toploadr is not affiliated with, and not responsible for, any transaction you make on a third-party marketplace.

08Intellectual property

The Toploadr app, website, name, logo, and design are owned by us and protected by intellectual-property law. These Terms don't transfer any of those rights to you beyond the limited right to use the Service. Pokémon, the Pokémon TCG, Nintendo, ONE PIECE, the ONE PIECE Card Game, Bandai (Bandai Namco), Cardmarket and eBay, and all related names, marks, and card artwork, are the property of their respective owners. Toploadr is an independent tool and is not affiliated with, endorsed by, or sponsored by Nintendo, The Pokémon Company, Bandai Namco, Cardmarket, or eBay.

09Account deletion & termination

You can delete your account and all associated data at any time from within the app: Dashboard → Settings → Delete account. This removes your collection, wishlist, sales, scans and account from our systems. If you cannot reach the app, email info@toploadr.app from the address you signed up with and we will delete it for you, see the account deletion page. Deleting your account does not cancel an active subscription; cancel that in the store as described above. We may suspend or terminate access if you materially breach these Terms or use the Service unlawfully. You can stop using the Service at any time.

10Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind to the maximum extent permitted by law. We don't guarantee that the Service will be uninterrupted, error-free, or that card data or prices will be accurate. This does not exclude any warranty that cannot be excluded under applicable law.

11Limitation of liability

To the extent permitted by law, Toploadr is not liable for indirect or consequential losses, or for loss of data or profit, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law, in particular, your mandatory rights as a consumer under Dutch and EU law are not affected.

12Changes

We may update the Service and these Terms as the app evolves. We'll change the "last updated" date above and, for material changes, give notice in the app or on this site. Continuing to use the Service after changes take effect means you accept the updated Terms.

13Governing law

These Terms are governed by the laws of the Netherlands, without affecting any mandatory consumer-protection rules of the country you live in. Disputes will be handled by the competent Dutch courts, unless mandatory law gives you the right to bring them elsewhere.
